If a store has received an adverse determination by the USDA, the store has the right to a judicial review of the determination. Section 14 of the Food and Nutrition Act (7 U.S.C.2023) and Section 279.7 of the Regulations (7 CFR 279.7) govern the right to a judicial review. The store must file legal action against the USDA by filling a Complaint in the U.S. District Court for the district in which the store owner lives in or is engaged in business, or in any court of record of the State having competent jurisdiction. The Complaint must name the United States as the defendant. The store has 30 days from receipt of the decision to file a Complaint.
